Is there a Release of Liability form for contractors coming in to do an inspection on a for sale home? The concern is that the owner not be sued and held liable for the contractor’s injury, etc, and that the contractor would be liable for any damage done as a result of the inspection.

1. I do not see any form similar to the CAR’s seller’s property questionaire (SPQ) I understand that it is an optional form. Is it required, necessary, or good to have?
2. If cannot find anywhere on the dre’s site, that an insurance claim disclosure is required. Is it required?
3. In your form library, I can’t find where would a seller disclose if there was a death in the last 3 years.
Also, is there a link or a list of required seller and agent disclosures for a listing?

The Seller’s Property Questionnaire is not required. We do not publish an alternative to it as a matter of policy. As an independent publisher, we only produce forms that either best suit the needs of the real estate industry, or are required by law.

One other question.. I do not see a seller’s property tax disclosure. I did come across form 317, but it seems like that form if for a buyer’s agent. Is there any form that covers property tax, and special tax disclosure?
on land deal, am I right in understanding, you use 167 to make the offer but 168 is used when there is an agreement to buy so it’s the actual contract. making it a two step process?

The Land Sales Contract (RPI Form 168) is an agreement infrequently used by a carryback seller in a sale of real property to retain title to the property until all or an agreed part of the purchase price has been paid.

never mind the irs code 1445 question, I see you combined it with the citizen/foreign status declaration. so since the agreement ask for an inspection and that is what you use to cover the buyers inspection elections and advisory, then that only leaves the five or six seller forms that I just can’t match up. If you can help with that I really appreciate it. And of course I so appreciate your company giving us an option other than car.

Does 304-2 refer to the Transfer Tax imposed by a California county of $1.10 per thousand or something else? If that is the only transfer tax applicaable does this form need to be included with the Purchase Agreement?

Do you have a hold harmless or other type form? I referred someone to a preforeclosure or auction property, and they will buy it on their own. I want to document that I have no knowledge of anything about the property. They want to pay me a fee. Your finder fee agreement does not fit this. Do you have any other form I can tailor? Rephrase: Is there an addendum or another form you could refer me to that would suit this particular situation when I am telling the client about the property? I would normally disclose everything, but in this unique opportunity there is nothing available to disclose as the property is locked shut and nothing will be known until after it is sold. I want it to be clear to the buyer this is an independent sale, with their own due diligence. If you could refer me to a brief paragraph that would be helpful, and then it could be tailored to fit in addition to form 114.

I agree with First Tuesday, that their forms are fine, but not everyone agrees. I had a similar experience when a seasoned real estate agent refused to accept an offer on a 1st Tuesday form. She had to ask her boyfriend who was a broker, and he agreed with me, which caused further resentment on her part. End result, she sent me the CAR forms which I used.
I would have a couple of requests, one would be forms for purchase and listing of mobile homes in a park.
Second would be to remove some of the large black heading on the 1st Tuesday forms as they consume a lot of ink.
Otherwise, the forms are good, simple and easy to use.

Jason Chu’s experience is what I expect from the SF BoR (SFAR). The truth is real estate is severely clique conscious business. You’re in “our” club or out. The clique mentality is girded by area war-lords otherwise known as realty boards who many times place their organizations agenda far above that of the agents they purport to support.
One suggestion, if the war-lords were genuinely interested in supporting the agents who pay them every month with their “dues”, is they would periodically review contracts and forms from all legitimate sources as to their separate strengths/weaknesses, rather than merely the forms they profit from selling to their members.
That said, the SFAR forms, largely, are better than CARs in my opinion. CAR forms have a pronounced lack of flexibility for modifying language. One example is CAR’s RPA just above the seller’s signature block on (what has been page-8, now with CARs new Nov-2014 form will be page-10). CAR enforces any modification of terms (Subject to attached Counter Offer….) to be just that, a Counter Offer, when in fact quite often due to verbal negotiations, the buyer’s agent modifies their offer before ratification by seller, with an Addendum. Their corporate-think leaves zero room for Addenda.
I should have added, that the First Tuesday forms are refreshing to find. I intend to become much more acquainted with them. Thanks for creating them.
Jason, I could not agree with you more. My own 20 year experience with the “war lords” has shifted my business operations to another level. MLS only options are great, and though needing to be a member of a local AOR is bitter sweet, it is not completly without it’s small merits. Although, in order to “be a “Realtor”, which I have been in the past, I find that the unsupported fees and linking association dues are really not necessary to pratice real estate. I have been using First Tuesday services and forms for decades and as long as they are in Real Estate Law compliance, I’m in.
I heard that if someone in Californiais in foreclosure you need to have them sign a 5 day right of rescission form do you have this form?
Mike, you referring to the NODPA – Notice of Default Purchase Agreement. That is only required when an investor is negotiating for the purchase of an owner occupied property when a NOD has been recorded.

However, the Bureau of Real Estate (CalBRE) clearly states and enforces the policy that seller’s agents, under their fiduciary duty owed to the sellers they represent, must present all offers received regardless of the form on which the offer is written.
Thus, a broker may use any form they choose. Other brokers, associations, and the MLS may not and do not require a broker to use a particular form.
But what is a buyer’s agent to do when faced with the stubborn reticence of a seller’s agent who is a trade union devotee?
It’s highly unlikely the typical non-REO seller is going to favor one form over the other. Thus, the request to use a specific form is easily traceable as a decision of the broker or agent, a blatant CalBRE violation. Rather than comply with an unethical request from a seller’s agent, file a complaint with CalBRE. Penalties for failure of fiduciary duty range from fines to license revocations, subject to CalBRE’s investigation.

I would also like to suggest that you remind the Listing Agent who is refusing to present your offer since you wrote them on “other forms” that not only are they opening themselves up to reprimand by the BRE, but they certainly are opening themselves up to a potential Lawsuit by their Client (as well as possibly by your client) especially if your offer ends up being “better” – their ignoring the Fiduciary Responsibility for their client will certainly end up harming them. Additional note – be sure to get their refusal in writing!
But, before you sue them, contact their Managing Broker – I would bet a dollar to a donut that their Managing Broker will accept your forms! If that individual who is refusing these forms is a Broker, then they are certainly an idiot, who has no business being in the Real Estate Business!
I would also like to point out that here in the San Francisco Bay Area, where I have worked, I have used all 3 “common” sets of forms, the SFAR forms, the PRDS forms as well as the more common CAR forms when I was active back in the mid-2000’s.
Today (Dec 2014) I now have discovered these First Tuesday Forms – and as an experienced Broker who has no desire to join NAR and CAR anymore, I really LOVE these FT Forms!
I just can’t believe that they are FREE!!! Especially for the high level of quality they are.
One of my favorite “features” I’m noticing about the FT forms, is that they “package” them.
That is what I used to do when I managed a very large Coldwell Banker office on the Peninsula. I packaged the forms together for Agents taking a Listing, or working with a Buyer, etc. All the forms were together with a cover – just like what FT is doing here!
Oh, and by the way, since all the FT forms are Adobe Acrobat forms, you can get yourself a FREE Adobe Acrobat Cloud account and save your filled-out form online and provide a private link to it for your client, or just for backup safety. You don’t need CAR’s expensive online Zipforms as they try to make you believe – you can get the same online cloud feature for free via Adobe’s website.
That said, I hope that FT is working on a truly online version of their forms, so that we never wonder if we are using the “latest” form, and also so that we don’t have to access a separate cloud service, like the one Adobe is offering. I would be willing to pay a reasonable subscription for that!

Dear Eric: Your comment could be taken as a reply to my event last April – the market in a part of Carlsbad was especially hot and I represented a buyer who wanted a particular house that had sold before even hitting the MLS. The property was a corporate relocation, and the buyer alerted me to the house hitting the MLS and I prepared an offer on the First Tuesday form, the buyer signed it, and we delivered it to the broker in Carlsbad who was the listing agent. The broker responded that the SELLER (again, a corporate relo) wanted the offer on an MLS form, and the broker sent me the form an an email attachment. From that point on all negotiations were done by email. The seller and seller’s broker really drove the deal – but if it was true that the seller required an offer to be on an MLS then I felt that I had little choice, and if I objected I risked the seller putting it back on the market and getting the buyer unhappy.
I am interested in your Forms Data Base. Have you experienced any push back from real estate boards, multiple listing services and/or real estate offices/agents who sometimes insist that all transaction documents; (example: Purchase offers, Counters, Disclosures, etc.) be made on Board/MLS forms?
i have received pushback regarding first tuesday forms…
on two fronts:
1) agents who don’t like to read contracts and are just plain “used to a certain form”
2) San Francisco board of realtors has a bunch of supplemental forms that are related to local ordinances
and codes , disclosures, etc related to San Francisco tenant law, environmental law, etc.
you can use 1st tuesday and I still do but you need to cover your rear with those supplementals
and sometimes…. a agent who is just dumb enough not to read will just tell me to put it on the SF BoR form or the CAR form.
@ Jason – when I first entered the SF market and was faced with using their disclosures etc, I just simply asked the Listing Agent to send them over to me. I never had an issue with a SF Agent not sending them to me, especially if they have already accepted my client’s offer.
Also, if that SF Agent is demanding that you use “his/her SF forms” then tell him/her to send you a set of SF forms, and you will be more than happy to ask your client if they want to fill them out and sign them.
In my opinion, it is ALWAYS BEST to be POLITE, and it is NEVER a good idea to get into a battle with another Agent. Too many Agents let their egos get ahead of what is really best for their Client and their Client’s interest. In legal terms, the Lawyers like to call it your Fiduciary Responsibility. I like to call it common respect within our Profession. :-)
Which form would I use on a vacant land tenancy, commercial/residential?
