Beginning January 1, 2025, all buyer agents must enter into buyer representation agreements with their buyer-clients when a buyer decides to work with an agent. The representation agreement is entered into before the agent begins the task of locating property for review with the buyer. This timing for authorization to represent a buyer is simply called “as soon as practicable” (ASAP).
For buyers who have independently located property and need assistance preparing and submitting a purchase agreement, the representation agreement must be negotiated and signed before the buyer reviews the prepared purchase agreement offer for signatures. [Calif. Civil Code §1670.50(a)]
