Why this matters: Owners and tenants of mobilehomes in spaces within a mobilehome park are captive clientele of the park owners. Park owners without a valid HCD permit may not evict tenants.
Valid permits for park operators
Mobilehome parks are required to be registered and titled with the Department of Housing and Community Development (HCD) in order to operate the park.
Mobilehome park operators are prohibited from evicting tenants or raising rents unless the park has a valid HCD permit.
When a mobilehome park operator does not have a valid permit, tenants may not be evicted for:
- nonpayment of rent or other charges; or
- plans to change the use of the park. [Calif. Civil Code §798.56]
