Calif. Business & Professions Code §§30; 135.5
Amended and added by S.B. 1159
Effective date: January 1, 2016
Beginning January 1, 2016, the California Bureau of Real Estate (CalBRE) will no longer deny licensure to an applicant based on their citizenship or immigration status. Individuals who apply for California Bureau of Real Estate (CalBRE) real estate licenses may provide an individual tax identification number (ITIN) in lieu of a social security number or Federal Employee Identification Number.
Editor’s note — This law gives CalBRE oversight over real estate practitioners who previously practiced real estate in the unlicensed grey market. Instead of retroactively addressing abuses based on complaints received from aggrieved clients, CalBRE is now able to proactively discipline bad actors through formal enforcement processes. For more on how CalBRE handles complaints, see the October 2013 article “CalBRE debuts its online complaint submission system.”
Selling real estate is not rocket science, but the test should make agents somewhat aware of laws, etc.
If agents knew how to get leads via the internet they wouldn’t need to pay Zillow.
Use technology and don’t let it abuse you
Are you all worried that illegal immigrants might be way more educated and successful than any of all of you with ignorant comments?!! Please there are enough jobs out there and deals for everyone. And remember success is for those who stay hungry for more and all of you always get “comfortable” and stop hassling that’s why deep inside you are all afraid of “us” the illegals who can hassle and always do better job than you because we need to always bring the bread home!
WELL SAID!!!!
I did wasted a few minutes reading this comments, its hard to avoid to smile … could be true that you could judge people by the way they think?
This is definitely not good, it is clearly for the money. I don’t like it, I don’t agree with it, it’s already a zoo out there as it is. Why don’t the people up in Sacramento take a pay cut for a change.
Enforce the laws already on the books for those who are violating BRE LAWS.. Prosecute then.. Don’t give them a license! This state has checked it’s common sense at the door.. It’s very disheartning.
Is this going to bring another wave of non-citizens who are willing to do a job for less? I don’t think you are going to see too much of this in the metros but what about the same areas that had so much fraud go on 7-10 years ago? I recognize the Ayes in the voting analysis. The same folks that don’t like private property rights anyway. Point of Sale, Rent Control, Smart Growth, Etc. Hopefully these legislators will get thrown out before they give state voting rights to non-citizens too.
Maybe the state will stop requiring fingerprints too as the next step.
Karen and Robert are right and Carlos you just proved their point.
THIS NEW REGULATION MAKES NO SENSE.
The business is already diluted with agents who are clueless about what they are doing. Why not make the testing more difficult to pass. I think the state is passing it so they can take in more money. Thank you Jerry Brown! How many licensed agents does California need? I’ve been in real estate since 1979 and feel that are profession has less integrity than when I started. If you want to get a securities license they make it very difficult . Very disappointing to hear this. Can you imagine what this will do to our industry? Bad enough that zillow and other sites are capitalizing on our listings and selling us on why we need to sign up as a preferred agent to get the leads that we should be getting amyway. Honestly, this may be our biggest threat to our industry.
One more reason I moved to NV. CA is becoming a third world state if it isn’t one already. The forces behind the destruction of America are appalling. What a slap in the face to those who became legal through due process.
Gladd you went toVegas Bob! Stay there, cause you have no clue!
The forces behind the destruction of America are IGNORANCE AND PEOPLE LIKE YOU COMBINED!
Carlos – your reply is inappropriate.
It is true that parts of California are like a third world country – you can’t deny that. The overall standard of living in California has declined due to the increased direct and indirect taxes that have been imposed, as well as having E and O insurance and worker’s liability etc.
Allowing non-citizens to get real estate licenses will not change the grey market – those on the fringe will remain – perhaps you are among them? Your protest was unusually sharp.
