I inherited a terrible tenant when my mom died in 2019 and left me her rental property. The tenant had a long history of paying rent weeks late, skipping payments, and refusing to communicate with my mother.
The eviction moratorium of last March was the 3rd time that the renter had stopped paying, since my mom died. (The first 2 times, I’d hired my mom’s lawyer to compel him to pay.) The tenant is totally ignoring me (and the lawyer) now, just as he ignored my elderly mother. He knows the laws are on his side, and there is absolutely nothing we can do about it.
I’m not entitled to the new government rent subsidy, as he’s a “high-income” tenant, and the subsidies are going to lower-income people. Not to mention, the tenant is totally uncooperative! I’ve actually never met the man, he’s so elusive.
So yes – I will sue to collect his past unpaid rent (currently $21,000 behind and counting) if I am ever able to get him out. However, I realize I probably don’t have a chance of ever collecting a penny of it. The main reason I plan to sue is to hopefully put a black mark on his record, in an effort to warn future landlords who might get fleeced by him.
The baffling thing is – he literally has the best bargain in the entire county! My mom never raised his rent, and even lowered it once at his request. He will never find a place this affordable ever again – and it’s in an extremely desirable neighborhood, too. I guess he figures he can never be evicted? But the way things are going, he may be right.
