The maximum base amount a trustee may charge to enforce obligations involved in a default after the notice of default (NOD) isrecorded, but before the notice of trustee’s sale (NOTS) has been posted, have been increased to:

  • $350 if the unpaid principal is $50,000 or less;
  • $350, plus 0.5% of the unpaid principal if the unpaid principal is between $50,000 and $150,000;
  • $300, plus 0.5% of up to $150,000 of the unpaid principal and 0.25% of any portion of the unpaid principal greater than $150,000 if the unpaid principal is between $150,000 and $500,000; or
  • $300, plus 0.5% of up to $150,000 of the unpaid principal, 0.25% of any portion of the unpaid principal greater than $150,000 and 0.125% of any portion of the unpaid principal greater than $500,000 if the unpaid principal is greater than $500,000.

Between the time of the NOTS being posted and the trustee’s sale, a trustee may charge a maximum base amount of:

  • $475 if the unpaid principal is $50,000 or less;
  • $475, plus 1% of the unpaid principal if the unpaid principal is between $50,000 and $150,000;
  • $410, plus 1% of up to $150,000 of the unpaid principal and 0.5% of any portion of the unpaid principal greater than $150,000 if the unpaid principal is between $150,000 and $500,000; or
  • $410, plus 1% of up to $150,000 of the unpaid principal, 0.5% of any portion of the unpaid principal greater than $150,000 and 0.25% of any portion of the unpaid principal greater than $500,000 if the unpaid principal is greater than $500,000.

The maximum fee a trustee may charge to facilitate a nonjudicial foreclosure sale has been increased from $425 to $475, or 1% of the unpaid principal sum secured, whichever is greater.
