This amendment revises previous regulation of recording real estate contracts.

Effective date: January 1, 2013
The maximum fee that may be charged by a county recorder’s office to record a real estate instrument is raised from $3.00 to $10.00.
The following items are recordable real estate instruments subject to this maximum fee (italics indicate new additions to the list):
- deed of trust;
- assignment of deed of trust;
- amended deed of trust;
- abstract of judgment;
- affidavit;
- assignment of rents;
- assignment of a lease;
- construction trust deed;
- covenants, conditions and restrictions (CC&Rs);
- declaration of homestead;
- easement;
- lease;
- lien;
- lot line adjustment;
- mechanics lien;
- modification for deed of trust;
- notice of completion;
- quitclaim deed;
- subordination agreement;
- release;
- reconveyance;
- request for notice;
- notice of default;
- substitution of trustee;
- notice of trustee sale;
- trustee’s deed upon sale;
- notice of rescission of declaration of default; and
- any Uniform Commercial Code amendment, assignment, continuation, statement, or termination.
