Analyzing the statement of deficiencies
A property manager or landlord conducting a joint pre-expiration inspection of a tenant’s premises prepares and provides the tenant an itemized list of repairs and cleaning the tenant needs to remedy or eliminate to avoid a deduction of costs from the security deposit. The property manager or landlord use the Statement of Deficiencies on Joint Pre-Expiration Inspection published by RPI to prepare and hand the tenant a copy or leave a copy on the premises at the time of the inspection. The Statement of Deficiencies on Joint Pre-Expiration Inspection contains:
- the date the pre-expiration inspection was conducted [See RPI Form 567-3 §1.1];
- the tenant and landlord’s identities [See RPI Form 567-3 §1.2];
- the real estate involved [See RPI Form 567-3 §1.3];
- whether or not the tenant was present for the inspection and a copy of the statement was handed to the tenant or left inside the premises [See RPI Form 567-3§§1.4 and 1.5];
- the expiration date of the tenancy or date the tenant will vacate [See RPI Form 567-3 §2];
- a notice to the tenant that they need to remedy the repairs and cleaning specified to avoid a deduction from their security deposit [See RPI Form 567-3 §3];
- repairs to be remedied [See RPI Form 567-3 §4.1];
- cleaning to be performed [See RPI Form 567-3 §4.2];
- excerpts from the California Civil Code §1950.5(b) and (d) [See RPI Form 567-3 §5]; and
- the landlord’s signature. [See RPI Form 567-3]
