Specific duties and delegation in a CID association

Pertaining to a common interest development (CID), the community association is now simply referred to as the association.
Under management services, the duty to supervise common area assets now specifically covers the collection, reporting, and archiving of those assets, with responsibility delegated to the association’s board of directors.
Education requirements for a certified CID manager
Amended by AB 691:
Business and Professions Code §§11502, 11502.5
The California Fair Employment and Housing Act is now added as part of the required coursework to become a certified CID manager.
The existing risk management education course requirement for a CID manager must now include maintenance, operations, and emergency preparedness.
The existing property protection for associations education course requirement for a CID manager is amended to include information on lead-based paint.
The existing management education course requirement for a CID manager is amended to include:
- the supervision of the collection, reporting, and archiving of the financial or common area assets of the association or common interest development;
- the management and administration of architectural standards;
- professional conduct and standards of practice for a CID manager; and
- conflict avoidance and resolution methods.
CID manager’s additional annual disclosure requirements

Business and Professions Code §11504
Prior to entering into or a renewing a contract with an association, a CID manager must annually disclose to the association whether his or his employer’s fidelity insurance specifically covers the current year’s operating and reserve funds of the association. However, an association may not force a CID manager to obtain or maintain fidelity insurance.
A CID manager must also annually disclose whether he possesses an active real estate license.
Unfair business practice of a CID manager

Business and Professions Code §11505
Unfair business practices of a CID manager now include the failure to provide:
- written disclosure to the association of the identity of and licenses held by the manager or management company, as required under Civil Code §1363.1; or
- annual disclosure of education, certified status, identity, insurance and licensure of a manager as required under Business and Professions Code §11504.

The CID manager requirements outlined in the Business and Professions Code will be repealed January 1, 2012, unless otherwise deleted or extended prior to that date.
