With a couple of exceptions, this is a very good summary. The one serious error is that real estate and loan agents should not be advising about how to hold title. OK to list options, but an attorney should advise. Too often I see married couples mistakenly holding title as joint tenants.; very rarely would that ever be appropriate. Also, lenders may do loans when titled in a typical living trust, but they may require a review and/ot attorney certification to do so. The old tactic of transferring out of trust and back into it after the loan closes can have unintended consequences.
