Public Resources Code §25402.10
On and after January 1, 2009, electric and gas utility companies must maintain energy consumption data for at least 12 months on all nonresidential buildings they service. The data must be kept in a format compatible for upload to the Environmental Protection Agency (EPA)’s Energy Star Portfolio Manager.
On and after January 1, 2010, the owner or operator of a building must disclose the energy consumption data for the most recent 12 months to any prospective:
- buyer;
- lessee of the entire building; or
- lender financing the entire building.
Once this disclosure is made, no additional information regarding the building’s energy consumption data needs to be given to the prospective buyer, lessee, or lender.
This section does not increase or decrease duties of any owner, operator, broker or agent to disclose material facts affecting the property.
