Neither a property owner nor a California Bureau of Real Estate (CalBRE) broker or agent representing an owner or buyer/tenant have a duty to voluntarily disclose a prior occupant’s HIV-positive status or AIDs-related death.

Editor’s note — The vague language of the law which existed prior to this clarification caused many CalBRE licensees to believe disclosure of prior occupant’s HIV-positive status or death from an AIDS-related illness was required. This new law merely clarifies existing law.
Do you have a disclosure form for the Cal. Civ. Code § 1710.2 for death in the rental within 3 years?

Thank you for your inquiry. A death may be disclosed in a blank section of the transfer disclosure statement (TDS). See RPI From 304.
