The association of a residential or commercial common interest development (CID) may now receive a notice or claim of a mechanic’s lien against title to a common area as an agent of the owners of separate interests in the CID. The association needs to notify each of its members within 60 days of receiving notice of the mechanic’s lien.
A mechanic’s lien may be placed against two or more separate interests in a CID. The owner of a separate interest may now remove a mechanic’s lien against their interest by recording a lien release bond for 125% of the amount of the lien attributable to their separate interest.
