The Civil Rights Housing Act of 2006 has been established, and does not affect the rules regarding senior citizen housing.

License revocation for fair housing violation or misrepresentation

A real estate license may be revoked or denied if the licensee induces or solicits the sale or lease of property by suggesting a loss of property value will occur due to the entrance into the neighborhood of a person of any certain race, color, religion, sex, sexual orientation, marital status, national origin, ancestry, familial status, source of income or disability, a condition commonly referred to as “block busting.”

A real estate license may also be revoked or denied if the licensee makes a false statement regarding his trade memberships, qualifications, designations, or credentials having to do with the real estate trade. The word ‘Realtor’ is protected for trade union membership without regards to its common meaning.

A condominium homeowners’ association may be denied licensure if it denies membership, use of facilities, or services based upon race, color, religion, sex, sexual orientation, marital status, national origin, ancestry, familial status, source of income or disability.

Deed provisions penalizing adherence to fair housing laws are void

Any deed provision penalizing a person for exercise of his right to sell, lease, rent, use, or occupy property based on race, color, religion, sex, sexual orientation, marital status, national origin, ancestry, familial status, source of income or disability is void.

CC&R provisions restricting fair housing are stricken

Any covenant, condition, restriction or deed relating title to property restricting the right to sell, buy, lease, rent, use, or occupy property based on race, color, religion, sex, sexual orientation, marital status, national origin, ancestry, familial status, source of income or disability is deemed omitted from the provision.

Fair housing rules for floating home marinas

Any organization requiring membership for tenancy in a floating home marina may not deny membership based on race, color, religion, sex, sexual orientation, marital status, national origin, ancestry, familial status, source of income or disability.

Fair housing and financing, insurance, construction and rehabilitation

A redevelopment agency must require that any residence that is financed, insured, constructed or rehabilitated may not discriminate based on race, color, religion, sex, sexual orientation, marital status, national origin, ancestry, familial status, source of income or disability. Any contractor or subcontractor engaged in construction or rehabilitation for such a property may not discriminate based on any of the listed factors in terms of employment. Any contract or subcontract dealing with the construction or rehabilitation for such a property may not discriminate on any of the listed factors.

Financial assistance and fair housing

A financial institution may not discriminate based on race, color, religion, sex, sexual orientation, marital status, national origin, ancestry, familial status, source of income or disability when determining the availability of financial assistance in the following housing activities:

  • purchasing;
  • constructing;
  • rehabilitiating;
  • improving; or
  • refinancing.
